Who this covers

This website, harryhedaya.com (the “Site”), is operated by Harry Hedaya (“we,” “us,” or “our”), with a business address at 5201 W Kennedy Blvd, Suite 925, Tampa, FL 33609, United States. This document is both our privacy policy and our terms of use. By using the Site, submitting a form, or downloading anything from it, you agree to what is written here. If you do not agree, please do not use the Site.

The Site is a personal and professional site. It is separate from the companies Harry is involved with (including Send It By Text, Power Admin AI, and Broadstaff), each of which has its own website, privacy policy, and terms. Nothing here applies to those services.

What we collect

We keep this minimal. Here is everything, by source.

Information you give us. When you use the contact form, we receive the name, email address, subject, and message you enter. When you request the Business Creation Checklist, we receive your email address, your first name if you provide it, and anything you type in the optional “what are you thinking of starting?” box. If you reply to an email from us, we receive whatever you send.

Information collected automatically. Like nearly every website, our hosting provider records standard server logs: IP address, browser type, device type, the pages you visit, the time, and the page that referred you. When you submit a form, we record your IP address alongside the submission to help prevent abuse. If you accept analytics cookies, Google Analytics collects usage data as described under Cookies below.

Bot protection. Our forms use Cloudflare Turnstile to tell people from automated scripts. Turnstile may process your IP address, browser characteristics, and similar technical signals to make that decision. It is governed by Cloudflare’s privacy policy.

We do not collect payment information, government identifiers, precise location, or sensitive personal information on this Site, and we ask that you not send it to us through the forms.

How we use it

We use the information above to:

• Respond to your message when you contact us.
• Send you the download link you requested, and let you know if it expired.
• Send occasional emails from Harry, such as new articles or resources, if you requested the checklist. Every such email includes a way to unsubscribe, and we honor unsubscribe requests promptly.
• Follow up with you about the partnership offer described in the checklist, if you shared an idea with us and it looks like a fit. We will not share your idea with anyone outside of the people helping Harry evaluate it.
• Keep the Site secure, prevent spam and abuse, and enforce these terms.
• Understand which pages are read, so we can write more of what is useful.
• Comply with legal obligations.

We do not sell your personal information, and we do not share it with third parties for their own marketing.

Cookies and analytics

A cookie is a small file a website stores in your browser. We use two kinds, and a banner asks for your choice the first time you visit.

Essential. A single browser setting (stored locally, not sent to any server) remembers your cookie choice so we do not ask again. Cloudflare Turnstile may set a cookie to complete its check. Our hosting provider may set cookies needed to serve the Site. These cannot be turned off because the Site does not work without them.

Analytics (optional). With your consent, Google Analytics sets cookies that let Google measure visits and page views on our behalf. We have configured it to anonymize IP addresses and we do not use it for advertising. If you reject analytics cookies, Google Analytics does not set cookies and does not store an identifier for you; it may still receive a cookieless, non-identifying signal that a page was viewed. You can change your choice at any time using the Cookie settings link in the footer of every page. Google’s own privacy policy and its opt-out browser add-on are available from Google.

Who we share it with

We use a small number of service providers to run the Site. Each only receives what it needs:

• Vercel hosts the Site and processes server logs and form submissions as they pass through.
• Mailgun sends our email and stores the email addresses of people who requested the checklist, along with the name and idea text you provided, so we can send follow-ups and manage unsubscribes.
• Google Analytics processes usage data if you accepted analytics cookies.
• Cloudflare provides Turnstile bot protection on our forms.

We may also disclose information if required by law, to protect our rights or safety or those of others, or as part of a sale or reorganization of the business that owns the Site, in which case this policy would continue to apply.

How long we keep it

Contact form messages are kept in our email for as long as we need them to handle your inquiry and any follow-up, and are then deleted in the ordinary course. Checklist signups stay on our mailing list until you unsubscribe or ask us to remove you. Server logs are retained by our hosting provider for a short period, typically days to weeks. Analytics data is retained by Google for the period set in our Analytics account, currently 14 months.

Your choices and rights

You can unsubscribe from our emails at any time using the link in any email or by contacting us. You can reject or withdraw consent to analytics cookies using the cookie settings link in the footer. You can also control cookies through your browser settings, which may affect how the Site works.

Depending on where you live, you may have the right to ask what personal information we hold about you, to receive a copy of it, to correct it, to delete it, to restrict or object to certain processing, or to withdraw consent. Residents of California, the European Economic Area, the United Kingdom, and other jurisdictions with privacy laws may have specific rights under those laws, including the right not to be discriminated against for exercising them. We do not sell or share personal information as those terms are defined in California law. To make a request, use the contact form and tell us what you would like. We may need to verify that you are the person the information relates to. We will respond within the time the applicable law allows.

We do not respond to browser “Do Not Track” signals, because there is no settled standard for them, but the cookie banner gives you an equivalent choice for the only optional tracking we use.

Security

The Site is served over HTTPS. Form submissions travel encrypted to our providers. Access to the mailbox and mailing list where your information lands is protected by strong, unique passwords and multi-factor authentication. No method of transmission or storage is perfectly secure, so we cannot promise absolute security, but we take reasonable measures appropriate to the small amount of information we hold.

Children

The Site is not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child has submitted information to us, contact us and we will delete it.

Terms of use

You may use the Site for lawful, personal, and informational purposes. You agree not to: use the Site in a way that could damage or overload it; attempt to gain unauthorized access to any part of it or the systems behind it; use automated tools to scrape it beyond what a normal search engine does; submit false information or impersonate anyone through the forms; or use the forms to send spam, unsolicited commercial offers, or anything unlawful, abusive, or infringing. We may block access for anyone who does.

Content and downloads

Everything on the Site, including the writing, the design, the photographs, and the Business Creation Checklist, belongs to Harry Hedaya or is used with permission, and is protected by copyright and other intellectual property laws. Company names and logos that appear on the Site belong to their owners.

You may read, print, and share the articles and the Checklist for personal and non-commercial use, provided you keep them intact and credited to Harry Hedaya and harryhedaya.com. You may not sell them, republish them as your own, remove the attribution, or use them to train or fine-tune an AI model without our written permission. Quoting short excerpts with a link back is welcome.

Download links we email you are personal to you and expire. Please do not post them publicly.

Disclaimers

Everything on the Site and in the Checklist is general information based on experience and opinion. It is not legal, tax, accounting, financial, investment, insurance, or security advice, and it does not create any professional or fiduciary relationship. Laws, platform rules, and market conditions vary by place and change over time. Confirm anything that matters for your situation with a licensed professional before acting on it. Where the Checklist or an article suggests prompts for AI tools, the output of those tools is your responsibility to verify.

The partnership offer described in the Checklist and on the Site is an invitation to start a conversation. It is not a binding offer, and no partnership, investment, or other relationship exists unless and until it is set out in a signed written agreement. We are under no obligation to respond to or accept any proposal, and we may decline for any reason or no reason. Please do not send us confidential information you are not prepared for us to see; we may already be working on, or later work on, similar ideas.

The Site links to other websites, including articles about Harry and the sites of companies he is involved with. We do not control those sites and are not responsible for their content or privacy practices.

The Site and its content are provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement. We do not promise the Site will be uninterrupted or error-free.

Limitation of liability

To the fullest extent permitted by law, Harry Hedaya and anyone working with him on the Site will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising out of or related to your use of the Site or its content, even if advised of the possibility. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you. You agree to indemnify us against claims arising from your misuse of the Site or breach of these terms.

Governing law

These terms and any dispute relating to the Site are governed by the laws of the State of Florida, without regard to its conflict of laws rules. You agree that the state and federal courts located in Hillsborough County, Florida have exclusive jurisdiction over any such dispute, and you consent to their jurisdiction. If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it.

Changes

We may update this page as the Site or the law changes. The effective date at the top tells you when it was last revised. Continued use of the Site after a change means you accept the revised version. If a change materially affects how we use information you have already given us, we will make reasonable efforts to let you know, for example by email if we have your address.
